1. Service Description

MySetPlan is an AI-powered fitness subscription service that generates personalized workout plans based on your goals, experience, equipment, and schedule. Our service includes customized workout plans, an exercise library, progress tracking, and related fitness resources.

The Service is provided on an "as is" and "as available" basis. By accessing or using MySetPlan ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Account Terms

  • One account per person: Each account is for individual use only. Sharing accounts or credentials is prohibited.
  • Accurate information: You agree to provide accurate and complete information when creating your account and updating your fitness profile.
  • Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • Age requirement: You must be at least 16 years old to use this Service.
  • Notification: You must notify us immediately of any unauthorized use of your account at contact@mysetplan.com.

3. Subscription and Billing

No Contract — Cancel Anytime

All MySetPlan subscriptions are commitment-free. You can cancel your subscription at any time from your account dashboard, and you'll retain access until the end of your current billing period.

3.1 Subscription Plans

We offer the following subscription options:

  • Monthly Plan: $6.99/month, billed monthly
  • Annual Plan: $69.99/year (save over 15%), billed annually

Prices are in USD and may vary by region. Current pricing is always displayed on our pricing page.

3.2 Free Trial

New users receive a 7-day free trial. During the trial, you have full access to all features. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. You will not be charged during the trial period.

3.3 Billing

  • Subscriptions are billed in advance (monthly or annually based on your plan)
  • You authorize us to charge your payment method through Stripe for all fees
  • Subscriptions auto-renew unless cancelled before the renewal date
  • Prices may change with 30 days notice; changes take effect at your next billing cycle

3.4 Cancellation

  • You may cancel your subscription at any time from your account dashboard
  • Cancellation takes effect at the end of your current billing period
  • You retain full access until the end of your paid period
  • Your workout data is preserved if you decide to resubscribe later

4. Refund Policy

Digital Subscription Policy: As a digital subscription service, we do not offer refunds after the 7-day free trial period. The trial is your opportunity to evaluate the service before committing. We encourage all users to take full advantage of the trial to ensure MySetPlan is right for them.

By subscribing after the trial period, you acknowledge that you have evaluated the service and agree to this no-refund policy. If you experience technical issues preventing you from using the service, please contact our support team.

5. Acceptable Use

You agree NOT to:

  • Share your account credentials with others
  • Redistribute, resell, or commercially exploit our workout plans or content
  • Attempt to reverse-engineer, decompile, or extract our AI algorithms
  • Use automated means to access, scrape, or download content from the Service
  • Attempt to access other users' accounts or personal information
  • Upload or transmit viruses, malware, or other malicious code
  • Interfere with the proper functioning of the Service
  • Use the Service for any illegal purpose

6. Medical Disclaimer

Important: MySetPlan provides fitness information, NOT medical advice. Our workout plans are for educational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.

You should consult a physician or other qualified healthcare provider before starting any exercise program, especially if you have any medical conditions, injuries, or concerns. We are not liable for any injuries, health issues, or adverse effects resulting from following our programs.

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, workout plans, exercise descriptions, AI algorithms, and software, are the exclusive property of MySetPlan and are protected by copyright, trademark, and other intellectual property laws.

Your License: You are granted a limited, non-exclusive, non-transferable license to use workout plans generated for you for your personal, non-commercial fitness purposes only. You may not redistribute, sell, or share these plans commercially.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYSETPLAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Personal injury or health issues resulting from use of the Service
  • Loss of profits, data, or other intangible losses
  • Interruption of service or loss of access
  • Any third-party conduct or content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Termination

By You: You may cancel your subscription and close your account at any time from your dashboard.

By Us: We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users or us, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination will survive.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in the State of New Jersey, United States, except that either party may seek injunctive relief in court for violations of intellectual property rights.

11. Changes to Terms

We may update these Terms from time to time. For material changes, we will notify you via email (to the address associated with your account) at least 30 days before the changes take effect. Your continued use of the Service after changes constitutes acceptance of the new Terms.

If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription before the changes take effect.
