1. Agreement to Terms

By accessing or using MySetPlan ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

MySetPlan is a subscription-based fitness service that provides personalized workout plans, exercise libraries, and fitness resources. The Service is provided on an "as is" and "as available" basis.

3. User Accounts

  • You must create an account to use certain features of the Service
  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to provide accurate and complete information when creating your account
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

4. Subscription and Payments

4.1 Subscription Plans

We offer various subscription plans with different features and pricing. Plan details and pricing are available on our website.

4.2 Free Trials

We may offer free trial periods. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

4.3 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • You authorize us to charge your payment method for all fees associated with your subscription
  • Prices may change with notice; changes take effect at your next billing cycle

4.4 Cancellation

  • You may cancel your subscription at any time from your account dashboard
  • Cancellation takes effect at the end of your current billing period
  • No refunds are provided for partial months or unused portions of your subscription

4.5 Refunds

Refunds are provided at our sole discretion. If you believe you are entitled to a refund, please contact our support team.

5. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Share your account credentials with others
  • Attempt to access other users' accounts or personal information
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated means to access or scrape content from the Service
  • Redistribute, resell, or commercially exploit our content without permission
  • Upload or transmit viruses, malware, or other malicious code
  • Interfere with the proper functioning of the Service

6. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, workout plans, exercise descriptions, and software, are the exclusive property of MySetPlan and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial fitness purposes.

The Service provides general fitness information and is not a substitute for professional medical advice. You should consult with a healthcare provider before starting any exercise program.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYSETPLAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Personal injury or health issues resulting from use of the Service
  • Loss of profits, data, or other intangible losses
  • Interruption of service or loss of access
  • Any third-party conduct or content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless MySetPlan and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any injury or damage resulting from following our programs

10. Third-Party Services

The Service may contain links to third-party websites or integrate with third-party services (e.g., Stripe for payments). We are not responsible for the content or practices of these third parties.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any such modifications.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of State of New Jersey, United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in State of New Jersey, United States, except that either party may seek injunctive relief in court for violations of intellectual property rights.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Fitness Disclaimer, constitute the entire agreement between you and MySetPlan regarding the Service.
